2. 合同協(xié)議：

本項(xiàng)目的中標(biāo)方必須與招標(biāo)方簽訂相關(guān)的物料采購(gòu)合同，就受雇于招標(biāo)方的不同承包商在項(xiàng)目安裝過(guò)程中所需的設(shè)備進(jìn)行供貨。設(shè)備的物料采購(gòu)合同由招標(biāo)方發(fā)出。

Remark: 1. Tenderers must price for all equipment required in the tender documents for this Project, any incomplete tenders will be rejected.

2. Contracting Arrangements: 

The successful Tenderer for this tender will be required to enter into a Material Procurement Contract with the Tenderee to supply equipment during the course of the Project for installation by various contractors employed by the Tenderee.

二、 投標(biāo)人的資格要求 Performance and Qualification Requirements：

投標(biāo)商有以下行為將會(huì)被拒絕參與投標(biāo)：

Tenderer will be refused if they have following behavior in the past years:

1、 近3年內(nèi)曾經(jīng)受到過(guò)政府部門或其他組織結(jié)構(gòu)就有關(guān)社會(huì)、勞動(dòng)、道德、健康、安全及環(huán)境違規(guī)行為進(jìn)行警告、處罰或批評(píng)的，或者發(fā)生過(guò)大規(guī)模罷工或嚴(yán)重的勞務(wù)糾紛、嚴(yán)重的火災(zāi)或安全事故、嚴(yán)重的工傷事故，或者嚴(yán)重的環(huán)境事故包括化學(xué)泄露，廢物處理等問(wèn)題。

In the past 3 years，tenderers have received any warning, punishment, notice of criticism from government or other organizations for social, labor, ethical, health, safety and environment violations, or encountered workers’ strike or serious labor dispute, encountered serious fire/safety accident, encountered serious work place injury, encountered serious environmental accidents, (e.g. chemical leakage, waste disposal issue) will be dis-qualified.

2、 在過(guò)去5年 內(nèi)投標(biāo)人或其高級(jí)職員、總監(jiān)、雇員、代理人、承包人或代表有向任何級(jí)別政府或國(guó)家機(jī)構(gòu)、國(guó)有企業(yè)或國(guó)際組織的任何高級(jí)職員或工作人員、或者有官方授權(quán)或代 表以上機(jī)構(gòu)行事的人，又或者政治機(jī)構(gòu)的候選人、政黨或政黨官員直接或間接地支付、提供、承諾支付或授權(quán)支付任何錢財(cái)、禮物或其他有價(jià)形式以期影響任何行 為、決定或獲取商業(yè)優(yōu)勢(shì)使自己或任何其他人獲得商業(yè)交易的行為。

In the past 5 years, tenderers or any of their officers, directors, employees, agents, contractors, delegates or representatives have been found guilty of paying, offering, or promising to pay, or authorizing the payment in each case directly or indirectly, of any money, gift, or anything else of value to any officer or employee of a government at any level or any state agency, state-owned agency or enterprise, or public international organization, or any person acting in an official capacity for or on behalf of any of them, or a candidate for political office, or a political party or party official, for the purpose of influencing any act or decision, either for any business advantage, to obtain or retain business, or to direct business to any person will be dis-qualified.

制造商的資格條件：

Qualification Requirements of Manufacture：

1. 具有獨(dú)立法人資格與相應(yīng)的許可經(jīng)營(yíng)范圍；

Must be legal entity with relevant licensed business scope;

2. 具有至少3年同行業(yè)相關(guān)從業(yè)經(jīng)驗(yàn)；

Have a minimum of 3 years’ relevant experience in this industry;

3. 在中國(guó)有永久的生產(chǎn)與售后服務(wù)、以及維修保養(yǎng)機(jī)構(gòu)，并具有完善的售后服務(wù)記錄。

Have permanent production and after-sales service and maintenance facility in China with completed after-sales records;

代理商的資格條件：

Qualification Requirements of Agent：

本項(xiàng)目不接受代理商投標(biāo)。

Supply through Agent is not allowed.

注：不接受聯(lián)合體和無(wú)法人資格的合營(yíng)公司進(jìn)行投標(biāo)。

Remark: Unincorporated Joint Ventures/Consortia may not bid.

三、 招標(biāo)文件購(gòu)買時(shí)須提交的資料

營(yíng)業(yè)執(zhí)照副本復(fù)印件及資格條件中規(guī)定的相關(guān)資格證明文件復(fù)印件，上述文件加蓋公章，原件備查。注：以上復(fù)印件均加蓋公章

四、 招標(biāo)文件發(fā)售時(shí)間

1、報(bào)名時(shí)間：2014年 8月29 日至9月4日9:00－15:00（節(jié)假日除外）

Registration time：since 2014-8-29 to 2014-9-4(Saturday, Sunday and holidays except)

報(bào)名材料：營(yíng)業(yè)執(zhí)照副本復(fù)印件及資格條件中規(guī)定的相關(guān)資格證明文件復(fù)印件，上述文件加蓋公章，原件備查。

Registration materials: business license copies and relative qualification documents copies specified in qualification conditions, these materials which must be stamped with official seals, original copies for checking if needed.

2、 招標(biāo)文件統(tǒng)一發(fā)售時(shí)間：2014年 9月5日 9:00－15:00

Selling time: 2014-9-5 9am-3pm

注：潛在投標(biāo)人在領(lǐng)取招標(biāo)文件前必須簽署招標(biāo)方提供的保密協(xié)議和員工權(quán)益聲明并加蓋公章。拒絕簽署該保密協(xié)議和員工權(quán)益聲明的潛在投標(biāo)人視為自動(dòng)放棄投標(biāo)資格，招標(biāo)代理機(jī)構(gòu)有權(quán)拒絕向其發(fā)售招標(biāo)文件。

Remark: The Tenderer must sign and seal Tenderee’s confidentiality agreement and Workers’ Right Declaration as provided by the Tenderee, and those who decline to sign the said agreement and Workers’ Right Declaration will be deemed as giving up the bidding qualification by themselves, tender agent has the right to refuse to sell tendering documents.
